The only difference I see is how the group with the two oxygens (one double and one single bonded) is connected at a different point to the ring structure. It should be connected at 6 o'clock like on the Tamiflu. This would make them constitutional isomers, correct?

Rotate the 1st structure counterclockwise by 120 deg and you get the 2nd. Therefore, it's the same thing.
